Board Meeting Minutes from July 13, 2004


In Attendance

  • Board members: Cary Ecker, Brad Scheevel, Brian Stern
  • Homeowners: Tiger King, Steve Moller, Howard Mathisen, Shari Clark

CC&Rs

  • Cary met with the Association's lawyer to discuss the possibility of amending the CC&Rs to allow enforcement of rules by having the ability to fine flagrant violators, as well as reviving the Architectural Control Committee.
  • The lawyer will draft amendments to Association's CC&Rs. He is currently on vacation, however.
  • The lawyer stated there was a standard fee schedule for violations and he will research that.
  • When Association is ready to approve the amendments, may call special meeting or provide pre-paid postcards for voting. Will need 75% majority to pass.
  • The lawyer stated there was a chance the board could still fine the recent roof violator on 139th Pl. if the roofing material was significantly different than others that have been approved. Cary received a sample of the roofing and it is significantly thinner than anything that has been approved.
  • The Association has received yard complaints about three homes in The Falls. One is for a backyard and that is not enforcable per the CC&Rs unless it is visible to the street. The remaining two yards are indeed messy and a warning letter will be sent to both.

Waterfall

  • The repairs to the waterfall are complete and it is fully operational again!
  • The total cost to repair was about $200 for the initial electrical work and about $3700 for replacement and work on the motor.
  • The flashing "alarm system" to indicate the breaker tripped has still not been installed. Cary will contact Alpha & Omega Electric to perform this work.
  • There is still concern about kids dumping soap in the waterfall, as this happened on the second day it was operational again. Some people think it's likely that Cathcart Way is pushed through there will be less privacy and that will cut down on the soaping incidents. If this is not the case, we may turn off the waterfall in the evenings.

Other

  • Brad is moving out of The Falls and has resigned as treasurer. By a unanimous vote, Tiger King is the Association's new treasurer.
  • A valve at the South end of The Falls has failed the annual backflow test required by Snohomish County, and this needs to be repaired. An estimate has been received for about $600.
  • Signs have been created to advertise the Association's web site. They are now attached to the North and South entrances to The Falls, and on one of the walkways. Also, stickers advertising the site have been placed on mailboxes.
  • The paperwork is notarized and ready to place liens on four homes that have not paid their dues nor made arrangements. The penalty incurred is a $150 lien fee (to cover recording fees and labor), and 18% per annum interest.
