Fine ScheduleThe Board of Directors has adopted fines to enforce the Association’s CC&R’s in accordance with state law (RCW 64.38.020). Violators could be fined $50 per week until they come into compliance with the CC&R’s.The most common violations include RV’s, boats, and travel trailers not parked in accordance to the CC&R’s, landscaping not kept up, or derelict vehicles parked on homeowner’s property. Most homeowners who attended the annual meeting in November agreed that this was a positive step for the Association. After an initial verbal and written notice the violator will be given a 30 day grace period to fix the problem. During this period no fines will be assessed and the homeowner has a right to appeal the violation to the Board of Directors. After the grace period, if the violation has not been fixed, the Board will begin to levy the $50 weekly fine. After 90 days, the Board can, at its discretion, take action to fix the problem and at the homeowner/tenant’s expense. The fines and expenses the Board levies can become a lien on the homeowner’s property. Speeding on Cascade Dr SEAt the annual meeting some homeowners complained about speeding on Cascade Dr SE. Speed bumps were suggested for the street.Association President Cary Ecker called the county Public Works concerning their Neighborhood Traffic Calming Program (NTCP). In reviewing the requirements for a “calming device” Cary concluded that Cascade Dr would probably not qualify for the program. We encourage everyone to discuss this with their neighbors and encourage them to go the speed limit within our community. Experience has shown that speeders often come from within our own community. Park ProblemsThe Board has been made aware of some potential flooding issues regarding a creek that goes through our south park area. The creek has the potential of endangering the back yards of some houses in the area. The Board is taking action to ensure that the creek stays within its bounds.Water PressureAlso, The Falls’ residents in the southeast corner of the development have had problems adequate pressure from the Silver Lake Water District water line. A permanent fix might require an additional water line through the Association’s property. The Board is looking into this situation.WaterfallThe waterfall has undergone continued repair and improvements. During 2004 the motor and portions of the electrical system were replaced. Also, parts of the electrical system were sealed to prevent shorting. Irrigation was added to the waterfall landscaping. Finally, Tiger King reinstalled flood lights to light up the waterfall at night.Web SiteDevelopment of the Association’s web site continues. At the January meeting, Brian Stern discussed improvements to the web site. He said that there is demand for a bulletin/message board to allow members to exchange information. Also, he intends to move the email address from Hotmail to our web site domain. This will be more logical and will be easier to maintain.Please note: Recently, you may have received a notice in the mail from a Windermere real estate agent announcing that “Your Neighborhood is now Online!” with a web site called www.thefallsneighbors.com. This is a web site that is sponsored by Windermere and NOT by your Homeowners Association. The web site advertises itself as providing a place to exchange information and to find information about our surrounding community. In some instances its information is misleading; specifically when it lists the City of Mill Creek as our local government (our local government is Snohomish County), our police department as Mill Creek Police Department (the Snohomish County Sheriff’s Office handles criminal matters for us) and only lists Fire District 7 as our servicing fire district when Fire District 7 services the southern portion of The Falls and Fire District 1 services the northern portion of The Falls. Also, this web site does not provide any information about your homeowner’s association. For newsletters, meeting minutes, CC&R’s and other information regarding your homeowner’s association go to www.the-falls.org County Animal ControlSnohomish County has shifted the Animal Control enforcement function from the Sheriff’s Office to the Auditor’s Office. This combines both pet licensing and enforcement into one office. If you need to contact an Animal Control Officer, call (425) 388-3440. If you have a life threatening problem with an animal, such as a dog bite, call 911.
